You may not use our website, products or Services for an illegal or unauthorized purpose.

You may not violate any applicable laws, including copyright, intellectual-property, privacy or consumer-protection laws.

You must not transmit viruses, malware, destructive code or any other harmful material.

A material violation of these Terms may result in suspension or termination of your access to the Services.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse or cancel Service where reasonably necessary, including in cases involving fraud, unlawful conduct, payment failure, misuse or violation of these Terms.

You understand that content submitted by you, excluding payment information, may be transferred over various networks and adapted to technical requirements.

Payment information is encrypted during transmission by our payment providers.

You may not reproduce, duplicate, copy, sell, resell or commercially exploit any part of the Service without our written permission.

The headings in these Terms are included for convenience and do not affect their interpretation.

SECTION 3 — ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We make reasonable efforts to keep information on this website accurate, complete and current.

However, website content is provided for general informational purposes and should not replace advice from a qualified professional where such advice is required.

The website may contain historical or archived information that is provided for reference only.

We may update or modify website content where reasonably necessary.

Nothing in this section limits any rights available under mandatory consumer law.

SECTION 4 — MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products may change without prior notice.

We may modify, suspend or discontinue a product, feature or part of the Service where legally permitted.

Price changes will not normally affect orders that have already been accepted.

Where an obvious pricing or technical error occurs, we may correct the error or cancel the affected order where permitted by law.

SECTION 5 — PRODUCTS AND RESPONSIBLE USE

Certain products may be available exclusively online and may have limited availability.

Returns and refunds are subject to our Return and Refund Policy.

We make reasonable efforts to display product colors, dimensions, materials and images accurately. However, appearance may vary depending on screen settings, lighting, manufacturing tolerances or product updates.

We reserve the right to limit sales by person, household, geographic area or jurisdiction where reasonably necessary and legally permitted.

SECTION 7 — OPTIONAL TOOLS

We may provide access to third-party tools, integrations, apps or services over which we do not have full control.

These tools may be provided on an “as available” basis and may be subject to separate terms and privacy policies.

Your use of optional third-party tools is at your own discretion and risk, subject to any legal rights that cannot be excluded.

New tools, features or Services introduced in the future may also be subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS AND SERVICES

Our website may contain links to third-party websites or use third-party services, including payment processors, fulfilment partners, carriers, analytics providers and marketing platforms.

We are not responsible for the content, security, availability or practices of independent third-party websites.

You should review the applicable terms and privacy policies before using third-party services.

Complaints regarding independent third-party products or services should generally be directed to the relevant provider, except where Comeback remains legally responsible as the seller.

SECTION 9 — REVIEWS, COMMENTS AND SUBMISSIONS

When you submit a review, photograph, testimonial, comment, suggestion or other material, you confirm that:

  • you own the content or have permission to share it;
  • it is truthful and based on a genuine experience;
  • it does not violate another person’s rights;
  • it is not misleading, unlawful, abusive or defamatory; and
  • it does not contain malware or harmful code.

You grant Comeback a non-exclusive, worldwide, royalty-free right to use, display, edit, reproduce, translate and publish submitted content for reasonable business and marketing purposes, subject to applicable privacy law.

We are not required to keep unsolicited submissions confidential, provide compensation or respond to them.

We may remove content that violates these Terms or applicable law.

SECTION 10 — PERSONAL INFORMATION

Your submission and use of personal information are governed by our Privacy Policy.

We may use third-party service providers to operate our store, process payments, fulfil orders, deliver products, provide support, analyze website activity and conduct marketing.

Your personal information will be handled in accordance with the applicable Privacy Policy and relevant data-protection laws.

SECTION 11 — ERRORS, INACCURACIES AND OMISSIONS

The website may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates or availability.

We may correct errors, update information or cancel an affected order where reasonably necessary and legally permitted.

If we cancel a paid order, the amount paid for the cancelled item will be refunded.

Nothing in this section allows us to disregard mandatory consumer protections.

SECTION 12 — PROHIBITED USES AND INTELLECTUAL PROPERTY

You may not use the website or its content:

  • for an unlawful or fraudulent purpose;
  • to violate any law or regulation;
  • to infringe intellectual-property, privacy or other legal rights;
  • to harass, threaten, abuse, defame or discriminate;
  • to submit false or misleading information;
  • to upload malware or harmful code;
  • to collect personal data without authorization;
  • to spam, phish, scrape, crawl or interfere with website operation;
  • to bypass security features;
  • to impersonate another person; or
  • to make fraudulent purchases, claims, reviews or returns.

All website content, including the Comeback name, logos, branding, images, videos, text, designs, guides and downloadable materials, belongs to Comeback or is used with permission.

You may not copy, reproduce, distribute, modify, sell or commercially exploit our intellectual property without prior written permission.

SECTION 13 — DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

We do not guarantee that the website will always be uninterrupted, timely, secure or error-free.

The website and Services are provided on an “as available” basis to the extent permitted by law.

We do not guarantee that use of the product will produce a particular result.

Product information is provided for general purposes and is not medical advice.

To the fullest extent permitted by law, Comeback and its directors, employees, agents, contractors, suppliers and service providers will not be responsible for indirect, incidental, special, punitive or consequential losses arising from use of the website or products.

We do not exclude or limit liability where doing so would be unlawful, including liability arising from fraud, intentional misconduct, mandatory product liability or other liability that cannot legally be excluded.

Nothing in this section limits statutory warranties, legal guarantees or mandatory consumer rights.

SECTION 14 — INDEMNIFICATION

To the extent permitted by law, you agree to compensate Comeback for reasonable claims, losses, damages and expenses arising from:

  • your unlawful use of the website;
  • your material breach of these Terms;
  • your infringement of another person’s rights; or
  • your fraudulent or malicious conduct.

This section does not apply where the relevant loss was caused by Comeback or where applicable law does not permit such an obligation.

SECTION 15 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum lawful extent or removed where necessary.

The remaining provisions will continue in effect.

SECTION 16 — TERMINATION

These Terms remain effective until terminated by you or us.

You may stop using the website at any time.

We may suspend or terminate your access where we reasonably believe that you have materially violated these Terms, engaged in unlawful conduct, committed fraud or threatened the safety or operation of the website.

Obligations and liabilities incurred before termination will continue where appropriate.

SECTION 17 — ENTIRE AGREEMENT

These Terms, together with the policies and notices referenced on the website, form the agreement between you and Comeback regarding your use of the Service.

They replace prior discussions, communications or agreements relating to the same subject matter.

A failure to enforce a provision immediately does not waive the right to enforce it later.

SECTION 18 — GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Netherlands.

However, this choice of law does not remove mandatory consumer protections available under the laws of a customer’s country of habitual residence where those protections apply.

Please contact us first so that we can try to resolve any dispute directly.

Nothing in these Terms prevents a consumer from bringing a claim before a competent court or using another dispute-resolution process available under mandatory law.

SECTION 19 — CHANGES TO THESE TERMS

You may review the current version of these Terms at any time on this page.

We may update these Terms by publishing a revised version on the website.

Changes apply from the published effective date.

Changes will not retroactively remove rights that already apply to completed purchases unless legally permitted.
